Please note that it is an offence to make a statement that is false or misleading in connection with an application under the Water Management Act 2000. Please read the terms below.

I, the approval holder, acknowledge and agree:

  1. I/we provide this notice in accordance with s 91IA of the Water Management Act 2000 and its Regulations as in force at this time (‘Notice’)
  2. WaterNSW, its officers, employees, agents and successors (‘WaterNSW’), accepts no liability in relation to any action, proceeding, claim, demand, cost, loss, damage or expense (including reasonable legal costs or expenses) arising directly or indirectly as a result of or in connection with this Notice or any act or omission of WaterNSW in connection with this Notice and I/we hereby agree to release and indemnify WaterNSW from and against any such action, proceeding, claim, demand, cost, loss, damage or expense to the fullest extent permitted by law;
  3. that all information contained in this Notice is accurate, true and complete and that WaterNSW will rely on such information; and
  4. that WaterNSW does not provide any legal, financial or technical advice in connection with this Notice and that any such advice, if required, is to be obtained independently.

Timeframes

Please note your obligations under the Water Management Act 2000 and its Regulations when submitting this Notice:

You must have the faulty meter repaired/replaced within 21 days of becoming aware of the faulty meter. If you require more time to repair/replace the faulty meter, you must submit a request for an extension available on our website. You may only use the work with a faulty meter within the first 21 days or after WaterNSW authorises any requested extension (together referred to as the ‘authorisation period’).

Once the meter has been repaired/replaced and within 28 days of the meter being repaired/replaced, you must provide a record of your water taken and provide evidence that the meter has been repaired/replaced by a duly qualified person.

Offences

  • It is an offence under s 91IA of the Water Management Act 2000 to fail to give notice that metering equipment is not operating properly, within 24 hours of becoming aware of the fact. A corporation found guilty of an offence against section 91IA is liable to a penalty no exceeding $2,002,000. An individual found guilty of an offence against section 91A is liable to a penalty not exceeding $500,500.
  • It is an offence under section 344 of the Water Management Act 2000 to make a statement that you know to be false or misleading in a material particular, or in connection with, this notice. A corporation found guilty of an offence against section 344 is liable to a penalty not exceeding $2,002,000. An individual found guilty of an offence against section 344 is liable to a penalty not exceeding $500,500.
  • It is an offence under section 91I(1) of the Water Management Act 2000 to intentionally or negligently fail to ascertain whether metering equipment is operating and take water from a water source to which Part 3 of the Act applies by means of a metered work while its metering equipment is not operating properly or not operating. A corporation found guilty of an offence against section 91I(1) is liable to a penalty not exceeding $5,005,000 and a further $264,000 for each day the offence continues. An individual found guilty of an offence against section 91I(1) is liable to a penalty not exceeding imprisonment for two years and/or $1,100,000 and a further $132,000 for each day the offence continues.
  • It is an offence under section 91I(2) of the Water Management Act 2000 to take water from a water source to which Part 3 of the Act applies by means of a metered work while its metering equipment is not operating properly or not operating unless authorised in writing by the Minister and the water is taken in accordance with any conditions of the authorisation and any requirements specified by regulation. A corporation found guilty of an offence against section 91I(2) is liable to a penalty not exceeding $2,002,000 and a further $132,000 for each day the offence continues. An individual found guilty of an offence against section 91I(2) is liable to a penalty not exceeding $500,500 and a further $66,000 for each day the offence continues.
